🔹 1. General Terms

By scheduling or purchasing any service provided by Bitwise IT – Services & Technology (“we,” “us,” “our,” or “Bitwise”), you (“client,” “you”) agree to the terms of this Service Agreement (“Agreement”).

This Agreement governs the relationship between Bitwise IT and its clients in accordance with the laws of the State of Nevada (NRS Chapters 598 and 80).

If any clause of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.


🔹 2. Client Responsibilities
  • The client is responsible for providing safe and clear access to the service location and must remove or secure fragile or valuable items prior to the technician’s arrival.

  • Pets must be kept in a separate area during the service.

  • Bitwise IT reserves the right to refuse or discontinue service in the event of unsafe environmentsfaulty electrical conditions, or inappropriate behavior.

  • If the client cannot be present, prior notice must be given if heavy or sensitive equipment needs to be moved.


🔹 3. Payment Terms
  • Estimates and diagnostics may be free unless stated otherwise.

  • Full payment is required upon completion of the service or as previously agreed in writing.

  • Bitwise IT does not offer credit, installment plans, or deferred payments.

  • If a service cannot be completed due to factors beyond our control (e.g., part shortages, access issues, or client unavailability), a minimum service fee of $25 will still apply.

Accepted Payment Methods:
💵 Cash (limited change up to $40)
💳 Credit/Debit Card (secure terminal or online link)
💲 PayPal, Zelle, or CashApp
📑 Business checks (returned checks subject to a $50 fee)


🔹 4. Plans and Discounts

Bitwise IT offers monthly maintenance plans and promotional discounts as announced.

  • Business Plans: may include preventive maintenance, remote support, and on-site visits.

  • Promotional discounts apply only to labor, not to equipment or parts.

  • Only one discount may be applied per service.

  • Proof of eligibility may be required for certain discounts (e.g., ID, company affiliation, age, or military status).


🔹 5. Equipment, Parts, and Replacements
  • Bitwise IT may assist clients in ordering necessary parts or equipment.

  • The company is not responsible for delays or defects caused by third-party suppliers.

  • Defective parts covered by a manufacturer’s warranty may be replaced at no cost.

  • If no warranty applies, replacement costs are the client’s responsibility.


🔹 6. Liability and Limitations
  • Bitwise IT shall not be liable for indirect, incidental, or consequential damages, including data loss, business interruption, or loss of profit.

  • The company’s maximum liability shall be limited to the total amount paid by the client for the specific service rendered.

  • Damages caused by proven negligence on the part of Bitwise IT will be assessed and resolved within seven (7) business days.

  • Bitwise IT is not responsible for failures caused by third-party software, malware, or misuse after service completion.


🔹 7. Safety and Injuries
  • Bitwise IT follows all safety procedures during service operations.

  • The company shall not be liable for injuries, accidents, or property damage unless directly caused by the technician’s negligence.

  • The client may be held responsible for injuries, bites, electrical hazards, or unsafe conditions at the service location.


🔹 8. Scheduling and Delays
  • Scheduled service times are approximate and subject to change due to external factors.

  • In the event of a delay exceeding 60 minutes without prior notice, the client may request a $25 service discount.

  • Cancellations must be made at least 4 hours in advance; otherwise, a travel fee may apply.


🔹 9. Service Area and Travel Fees
  • Main service area: Las Vegas, North Las Vegas, Henderson, and Boulder City.

  • Services outside these areas may include a travel fee between $25 and $50, depending on distance.

  • Bitwise IT reserves the right to decline service beyond Clark County, Nevada.


🔹 10. Right to Refuse Service

Bitwise IT reserves the right to refuse or discontinue service due to:

  • Unsafe working conditions,

  • Lack of cooperation,

  • Illegal requests, or

  • Violation of this Agreement.


🔹 11. Rates and Additional Labor
  • Standard services include up to 1 hour of labor.

  • Additional labor hours are billed at $75 per hour, unless otherwise agreed.

  • Extended or multi-day projects may include travel or scheduling fees, discussed in advance.


🔹 12. Service Warranty
  • Bitwise IT guarantees its services for 15 calendar days following completion.

  • The warranty covers only the original service performed, not new issues or misuse.

  • Part replacements follow manufacturer warranty terms.


🔹 13. Confidentiality and Data Protection
  • All information accessed by Bitwise IT (files, passwords, systems, etc.) is treated as strictly confidential.

  • No data will be copied, shared, or stored without the client’s consent.

  • In compliance with the Nevada Data Privacy Law (NRS 603A), Bitwise IT applies appropriate safeguards to prevent data breaches or unauthorized access.


🔹 14. Legal Provisions
  • This Agreement is governed by the laws of the State of Nevada, Clark County.

  • Any disputes shall first be subject to mediation.

  • If unresolved, the competent venue shall be the Clark County Justice Court, Las Vegas, NV.

  • Nothing in this document limits the client’s rights protected by state or federal law.


🔹 15. Acceptance of Terms

By requesting or scheduling service, the client confirms that they:
✔ Have read and understood this Agreement;
✔ Agree to all payment, responsibility, and warranty terms;
✔ Authorize Bitwise IT to perform necessary technical work as described.
